Memlükler dönemi Hanefilerinde içtihad ve taklid tartışmaları

Abstract

Memlükler dönemi Hanefilerinde içtihad ve taklîd tartışmaları başlığını taşıyan tezimizde bu dönem içtihad ve taklîd düşüncesi bağlamında Hanefilerde yaşanan gelişmeleri ve yenilikleri konu edindik. Bazı yenilikçi yaklaşımlara ve ilmi tartışmalara sahne olan bu dönemin Hanefiler üzerindeki etkilerini araştırmanın ve bu yaklaşımları benimseyip benimsemediklerini ortaya çıkarmanın günümüz fıkıh araştırmalarına yeni katkılar sunacağını düşündüğümüz için, bu tartışmaların odağında bulunan içtihad ve taklîd konuları bağlamında bu dönem Hanefilerini çalıştık. Döneme dair klasik kaynakların tespiti ve görüşlerin taranması işlemlerinin yanısıra görüşlerin tahlili ve önceki dönem Hanefi usul eserleriyle ve diğer mezhep usul literatürüyle mukayese yöntemlerini kullandığımız tezimizde, Memlükler dönemi Hanefilerinin içtihad ve taklîd düşüncesi bağlamında önceki dönemlerden pek çok konuda farklılaştıkları sonucuna vardık. Tezimizde, yaşanan bu değişime etki etmiş olabilmesi açısından, içinde bulunulan tarihi dönemi tanıma amacıyla Memlükler döneminin siyasi, ilmi ve mezhepsel durumunu da kısaca ele aldık. Son olarak bu tartışmaların sonraki dönemlere ve günümüze etkilerini görme adına tartışmaların izlerini Memlükler sonrası dönemlerde ve modern dönemde sürmeye çalıştık.

In our thesis titled “Ijtihād and taqlīd discussions in the Mamluks Ḥanafīs” we discussed the developments and changes in the thought of ijtihād and taqlīd in the Ḥanafīs of this period. As a matter of fact, this period witnessed some innovative approaches and scientific debates in the field of Islamic law. Since we think that researching the effects of this period on Ḥanafīs and revealing whether they adopted these approaches or not will make new contributions to today's fiqh studies, we have studied Ḥanafīs of this period in the context of ijtihād and taqlīd which are at the center of these discussions. In our thesis, in which we used the methods of determining classical sources, scanning and analyzing opinions about the period, as well as comparing methods with the previous Ḥanafī uṣūl al-fiqh works and other madhhabs uṣūl al-fiqh literature, we came to the conclusion that the Ḥanafīs of the Mamluk period differed from the previous periods in many aspects in terms of ijtihād and taqlīd thought. We tried to briefly illuminate the political, scientific and maddhab situation of the Mamluks period in order to recognize the historical period in terms of the fact that it may have affected this changes in our thesis. Finally, in order to see the effects of these debates on the following periods and today, we tried to follow the traces of the debates in the postMamluks and modern periods.
